The Calcutta High Court on Tuesday refused to grant interim bail to Sharmista Panoli, a 22-year-old law student and social media influencer, who was arrested for allegedly hurting religious sentiments through her online comments. The court stated that freedom of speech is not absolute and must be exercised with responsibility in a diverse country like India.
Panoli had posted abusive remarks on social media while responding to discussions related to India’s Operation Sindoor. The court observed that her comments had hurt the sentiments of a section of the population. “Sentiments of a section of the people of our country have been hurt. We have freedom of speech, but that does not mean you hurt the sentiments of others. Our country is full of diversity,” the High Court said during the hearing.
Although Panoli has issued an apology for her comments, the High Court did not grant her interim relief. The case is being heard under sections related to promoting enmity and hurting religious sentiments. Further proceedings are expected as the matter remains under judicial consideration.
